In the following Terms and Conditions, any use of ‘we’, ‘our’, or ‘us’ refers to D Bianco. Any use of ‘you’ or ‘your’ refers to our customers.
This website and its contents are owned and operated by D.A. Ferreira Bianco & F. Ferreira Bianco (D Bianco), ABN 57550480789. By using this website, you agree to accept and comply with these terms and conditions, including our Privacy Policy.
By engaging with our services, you are deemed to have read, understood, and agreed to be bound by these Terms and Conditions at all times.
These Terms apply to all products purchased from D Bianco through our website, quotations or invoices. By placing an order, paying a deposit or approving production, you accept these Terms.
Nothing in these Terms excludes any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
ORDERS AND APPROVALS
D Bianco products are handcrafted and made to order.
Production begins after we receive the required payment, final approval of drawings, dimensions, finishes and specifications, and all information necessary to manufacture the product.
Customers must check all drawings, measurements, quantities, finishes and electrical specifications before approval. Changes requested after approval may incur additional costs and extend the lead time.
NATURAL MATERIALS
Our products use natural and individually finished materials, including brass, quartz, selenite, timber and electroplated metals.
These materials may naturally vary in colour, tone, grain, veining, texture, mineral inclusions, surface character, transparency and clarity. Hand-finished and electroplated surfaces may also vary slightly between components and production batches.
These characteristics make every product unique and are not defects, provided they do not materially affect the product’s structural integrity, electrical safety or intended function.
Samples, photographs and renders are indicative only and cannot guarantee an exact match.
PRICES AND QUOTATIONS
Prices are in Australian Dollars (AUD).
Unless another period is stated, quotations are valid for 30 days.
Prices may change before an order is accepted. Confirmed prices will not change except for customer-requested variations, changed specifications, incorrect customer-supplied information or other charges agreed in writing.
PAYMENT
We accept Visa, Mastercard and direct bank deposit.
All payments must be received as cleared funds before products are released. Ownership remains with D Bianco until payment is received in full.
CHANGES AND CANCELLATIONS
Changes or cancellations may not be possible after an order is confirmed or production has commenced.
Approved changes may incur additional costs and extend the lead time.
If D Bianco accepts a cancellation after work has commenced, we may retain or recover reasonable costs already incurred, including design, administration, materials, supplier commitments and completed manufacturing work.
LEAD TIMES
The estimated production lead time is 4–12 weeks, excluding delivery, unless stated otherwise.
Lead time begins after received payment, final approvals and all required information have been received.
Customer changes, delayed approvals or incomplete information will extend the lead time. D Bianco will use reasonable efforts to meet estimated dates but is not responsible for delays caused by circumstances beyond our reasonable control.
DOMESTIC SHIPPING
Australian orders are shipped using Australia Post or another suitable courier. Delivery generally takes 2–8 business days after dispatch.
Customers are responsible for providing accurate delivery information and suitable access.
INTERNATIONAL DELIVERY — DAP
Unless agreed otherwise, international orders are supplied:
DAP — named destination stated in the quotation — Incoterms® 2020.
D Bianco arranges transportation and export clearance to the named destination.
The customer acts as importer of record and is responsible for import clearance, EORI or other registrations, duties, VAT/GST or other taxes, customs and brokerage charges, permits.
Risk transfers when the products are available at the named destination, ready for unloading.
Additional costs caused by the customer’s failure to complete import requirements or provide documents are payable by the customer.
Customers must confirm that the product’s voltage, driver, dimming system and certifications comply with local requirements.
DELIVERY AND STORAGE
Customers must be ready to receive completed orders after receiving reasonable notice.
D Bianco does not ordinarily provide storage. If the customer cannot accept delivery, reasonable storage, handling and redelivery charges may apply after seven days.
DAMAGE IN TRANSIT
Inspect all packages promptly after delivery.
If damage is visible:
- Photograph or video the external and internal packaging;
- Retain the packaging and shipping labels;
- Do not install a visibly damaged electrical product; and
- Notify info@dbianco.com.au within two business days, where reasonably possible.
Prompt notification helps us claim against the courier. A late notification does not remove any statutory rights.
INSTALLATION
All lighting must be installed by a licensed electrician or, outside Australia, an appropriately qualified professional under local law.
The customer and installer must confirm that the structure, mounting points, dimensions, electrical supply, driver, dimmer and control system are suitable.
D Bianco is not responsible for damage caused by incorrect installation, inadequate structural support, incompatible equipment, unauthorised modification or failure to follow our instructions.
CARE AND MAINTENANCE
- Before cleaning, switch off and isolate the electrical supply.
- Clean braided fabric and timber using a soft, dry cloth or duster. Clean metal components using a clean, damp microfibre cloth.
- Do not use abrasive products, acids, solvents, detergents, glass cleaners or harsh chemicals. Avoid touching finished metals directly and protect products from prolonged direct sunlight, excessive heat, moisture, grease and dirt.
- Indoor or dry-rated products must not be installed in wet, damp or exterior locations.
- Do not place rope or timber elements above or near heating elements, moisture, grease, and dirt as this may create a fire hazard.
- Do not expose Clear Quartz to direct sunlight for prolonged periods of time.
- Do not install or place Selenite in wet or high-moisture areas, or expose it to direct sunlight.
- Electrical issues must be assessed by a licensed electrician.
LIGHTING OUTPUT
Customers must review the product’s wattage, lumen output, colour temperature, driver and dimming specifications before ordering.
Perceived brightness and colour may vary according to the room, surfaces, ambient lighting and installation height.
RETURNS AND REFUNDS
Because D Bianco products are custom-made, we do not accept returns, exchanges or refunds for change of mind, incorrect selection, customer-approved dimensions or expected natural material variations.
This policy does not affect rights relating to faulty, unsafe, misdescribed or non-compliant products.
WARRANTY
D Bianco provides:
- A four-year voluntary warranty for residential use; and
- A two-year voluntary warranty for commercial use.
The warranty begins on the delivery date and covers defects in materials and workmanship.
If a warranty claim is accepted, D Bianco may repair or replace the affected product or component.
The voluntary warranty does not cover damage caused by:
- Normal wear or expected natural aging;
- Incorrect cleaning, handling or storage;
- Incorrect or unlicensed installation;
- Incompatible or unauthorised drivers, dimmers or components;
- Misuse, modification or use outside the product’s rating;
- Inadequate structural support;
- Power surges or electrical supply problems; or
- Flood, fire, lightning, water damage or other external events.
These exclusions apply only where the excluded circumstance caused or contributed to the damage. They do not limit statutory rights.
The voluntary warranty does not cover removal, access equipment, installation, reinstallation, electrician or third-party labour costs.
SAMPLE KITS
Sample kits may be returned in excellent, complete condition.
Where an order is placed, the kit may be returned for a credit. If no order is placed, it may be returned for a refund. Original and return shipping costs are excluded.
Natural variations mean samples cannot guarantee an exact match to the finished product.
PURCHASE ORDERS
Customer purchase-order terms do not replace these Terms unless D Bianco expressly accepts them in writing.
Accepting a purchase order, payment or commencing production does not mean D Bianco accepts conflicting customer terms.
Where documents conflict, the order of precedence is:
1. A contract signed by both parties;
2. D Bianco’s order confirmation;
3. The accepted quotation;
4. Approved drawings and specifications; and
5. These Terms.
INTELLECTUAL PROPERTY
All D Bianco designs, drawings, photographs, renders, specifications and website content remain the intellectual property of D Bianco or the relevant rights holder.
They may not be copied, manufactured, reproduced or commercially used without written consent.
Architects and interior designers may use supplied images and technical files solely to present or specify genuine D Bianco products.
PRIVACY
Personal information is handled in accordance with applicable privacy laws and our Privacy Policy.
GENERAL
These Terms are governed by the laws of New South Wales, Australia.
If any provision is invalid or unenforceable, the remaining provisions continue to apply.
D Bianco may update these Terms. Updated Terms apply only to future orders. The Terms accepted when an order is confirmed continue to govern that order unless both parties agree otherwise in writing.
